Version 1.0.1 · Effective 2026-10-13 · Posted 2026-10-13 · Last updated 2026-10-13
In plain English. This summary is here to help you read the terms. It is not part of them, and the full text
below controls.
Who the contract is with. These terms are a contract between your organization and TechSolve LLC, the company
that makes Tartan Networks. Whoever accepts them for an org confirms they are allowed to.
Who can use Tartan. You must be 18 or older. Tartan is built for organizations.
How you use it. Use Tartan lawfully and follow the Acceptable Use Policy. We can suspend orgs that abuse it or
put others at risk.
Your traffic. Traffic between your devices is end-to-end encrypted, and our relays can't read it. On the hosted
service we hold your org's network certificate authority so we can run your network. We promise never to use it to
join your network or read your traffic.
Your data. Your org's data stays yours, and we use it to run the service. To improve Tartan we use only
aggregated or de-identified data. We don't sell your data, run ads on it, or train AI on it.
Our liability. Tartan is provided "as is". Our liability is limited to the greater of $100 or what you paid
us in the last 12 months.
Changes to these terms. We'll change these terms as Tartan grows. We post every change in a dated changelog.
Big changes are announced in your console at least 30 days before they take effect, and if you keep using Tartan
after that, you accept them. We never widen how we use your data without an Owner's explicit OK.
Disputes. Kentucky law applies, and disputes go to the courts in Kentucky. There are no class actions and no
jury trials.
1. Who these terms are between
1.1 These Terms of Service ("Terms") are an agreement between TechSolve LLC and the organization that uses Tartan
(the "Customer" or "you"). TechSolve LLC is a Kentucky limited liability company at 187 Pavilion Pkwy #131, Newport, KY 41071. It makes
the Tartan Networks product and is called "Tartan", "we" or "us" in these Terms. "Tartan Networks" is the
name of the product. The contracting party is always TechSolve LLC.
1.2 How these Terms are accepted. These Terms bind an organization when a person accepts them for it in the
console. That happens either when the person creates the org, or, for an org that existed before these Terms were
published, at the first sign-in after publication.
The person who accepts confirms that they have authority to bind the organization.
Each later use of the Service by your org is on these Terms.
If you use Tartan for yourself rather than for an organization, you are the Customer.
1.3 People in your org. Your "Users" are the people you let use your org, such as admins, techs and device
users. You are responsible for your Users following these Terms, and for everything done under your org. Installing
the Software or enrolling a device does not make a User a separate party to these Terms. Their use is covered by your
org's acceptance.
1.4 Other documents. These documents also form part of these Terms:
the Data Processing Addendum (the "DPA"), which applies to every org that
uses the hosted Service, without a separate signature;
any order form or pricing you agree to.
The Privacy Policy explains how we handle personal data.
If these documents conflict, they take priority in this order:
an order form signed by both parties;
the DPA, for personal data;
these Terms;
the Acceptable Use Policy.
1.5 Eligibility.
You and every User must be at least 18 years old. Tartan is not directed to children.
For now, the hosted Service is offered to organizations established outside the European Economic Area, the United
Kingdom and Switzerland.
2. What Tartan is
2.1 The Service. Tartan Networks lets an organization run a private, encrypted network between its devices. The
"Service" is made up of:
the hosted control plane and web console;
hosted lighthouses and relays;
org DNS zones and certificates;
the Tartan software, meaning the Windows agent, Tartan Mobile, and any other client or self-hosted component we
provide (the "Software");
related documentation and support.
2.2 Hosted and self-hosted. You may use Tartan's hosted control plane, or run the control plane yourself where we
offer that.
When you self-host, we do not receive or process your network data. Only the Software terms in section 4 and the
general terms apply.
When you use the hosted Service, section 7 applies.
2.3 Changes to the Service. We improve Tartan all the time, so features may change, be added or be retired. If we
remove a material feature you pay for, we will give notice under section 13 and, where reasonable, a pro-rated refund
of the prepaid fees for it.
2.4 Previews. Features labelled preview, beta, pilot or similar are provided as they are. They may change or stop
at any time, and they are excluded from any service commitment.
3. Your org, accounts and keys
3.1 Sign-in. People sign in with passkeys, or through your organization's own identity provider. We store no
passwords. You are responsible for:
who your org approves as an admin;
the devices it approves;
keeping its devices and passkeys secure.
3.2 Org names. Your org may receive a name under a Tartan domain (for example <org>.tartn.net).
The domain belongs to us. You may use the name while your org is active.
We may reclaim or change a name that infringes someone's rights, misleads people or is abused. When we reasonably
can, we will tell you first.
We may reclaim the name of an org that has had no active devices for 12 months.
3.3 Keys and certificates.
On the hosted Service. Tartan's signing service creates and holds your org's network certificate authority and
related keys, so that it can run your network.
We use those keys only to provide the Service to you.
We will never use them to add a device or identity of our own to your network, or to decrypt or inspect your
traffic.
Access to them is limited to the automated signing service and to logged, restricted administration.
Self-hosting. If you self-host, the certificate authority stays with you.
Leaving. If you leave, we will help you move your org to a control plane you run, as our documentation
describes, where that is technically supported.
Legal demands. If a legal demand seeks to compel us to use your keys in a way this section forbids, section 7.6
applies, and we will resist it to the extent the law permits.
3.4 Access you grant to others. If your org grants another org access to your devices or resources, or accepts
access from another org, the org that grants the access is responsible for that choice and its consequences. Tartan
carries out the grant as configured. Tartan is not a party to the relationship between the two orgs.
4. The Software
4.1 Licence. While these Terms apply, we grant you a limited, non-exclusive, non-transferable, revocable licence to
install and use the Software, for your organization's internal purposes, on devices you control, and in line with the
documentation.
4.2 Open-source components.
Parts of the Software are open source, including our fork of Nebula, which is under the MIT licence.
Those parts are governed by their own licences, which are listed in the notices shipped with each app and at
https://tartannetworks.com/licenses.
Nothing in these Terms limits your rights under those licences.
4.3 Restrictions. Except where the law or an open-source licence allows it, you may not:
copy, modify or create derivative works of the closed-source Software;
reverse engineer, decompile or disassemble it;
remove its notices;
resell, sublicense or rent it;
use it to build a competing service.
4.4 Updates.
The Software may update itself, or ask you to update it, so that it stays secure and compatible.
Some versions may stop working with the Service once they are out of support.
The stores we distribute through, and Microsoft's code-signing service, have their own terms. Those terms also apply
to how you get the Software.
4.5 App stores. If you got Tartan Mobile from Google Play, this licence is between you and us, not Google. Google
Play's terms prevail where they conflict with these Terms.
5. Acceptable use
5.1 You will use the Service only lawfully, and in line with the
Acceptable Use Policy.
5.2 You are responsible for what your devices send over your network. You are also responsible for having the rights
and consents that your use needs, including any you need to monitor or route your Users' traffic.
6. Fees
6.1 Free use.
Some of the Service is free today.
We may change what is free, or start charging for something that was free. If we do, we will give at least 30 days'
notice under section 13, and you may stop using that part before the charge starts.
6.2 Paid features.
Paid features are billed as shown when you buy them, or as your order form sets out.
Fees do not include taxes. You pay any applicable taxes, other than taxes on our income.
Unless your order form says otherwise, fees are non-refundable except as these Terms provide.
We may suspend paid features after notice if an invoice is more than 30 days overdue.
7. Your data
7.1 Your data stays yours.
"Customer Data" means the data your org and its devices put into the hosted Service. Examples are device names,
configuration, names in your org's DNS zone, and the people in your org.
You own Customer Data. You give us the rights we need to host, process and transmit it in order to provide, secure
and support the Service.
7.2 Your traffic.
Traffic between your devices is end-to-end encrypted. Tartan's relays may carry it, but they cannot read it.
We do not inspect, log or store the contents of your traffic.
Section 3.3 sets out how we hold and limit the use of the keys that run your network.
<!-- data-use -->
7.3 Improving Tartan.
In addition to processing Customer Data to provide the Service, we may create aggregated or de-identified
information from use of the Service, and use it to operate, secure and improve Tartan. Examples are counts,
performance and reliability statistics.
This information is designed not to identify you, your Users or any device. We will not try to re-identify it, and
we will require anyone we share it with to make the same commitment.
We do not sell Customer Data, use it for advertising, or use it to train AI models, whether our own or a third
party's.
Any change to this section follows section 13.3.
<!-- /data-use -->
7.4 Personal data.
When we process personal data in Customer Data, we do so as your processor or service provider under the DPA.
You are responsible for having a lawful basis for the personal data you put into the Service, and for giving your
Users any notices the law requires.
If we become aware of a security breach that affects your Customer Data, we will notify you as the DPA sets out.
7.6 Legal requests.
If a government or court asks us for Customer Data, we will direct it to you, unless the law forbids us to.
Where the law allows, we will tell you about the request.
We disclose only what we are legally required to disclose.
7.7 Deletion.
An org Owner may ask us to delete the org, or particular Customer Data, by writing to privacy@tartannetworks.com.
We will verify the request and carry it out within 30 days.
Today we carry out deletion by hand. We delete or de-identify live records where our systems allow it.
Some records outlast a deletion. The Privacy Policy explains which ones and why: security and audit records,
certificate records, and backups, which expire on a fixed schedule.
We are building self-service deletion in the console. When it is ready, it will be the way you delete, and we will
update these Terms under section 13.
7.8 Export. While your org is active, you can export its configuration with the tools the Service provides.
7.9 Confidentiality.
We will keep Customer Data, and any non-public information about your org's network and keys, confidential.
We will use it only to provide the Service, and disclose it only to:
our personnel and subprocessors who need it for that purpose and are bound by confidentiality duties at least as
protective as this section; or
others, as section 7.6 allows.
You will keep our non-public information confidential in the same way. That includes Software that is not open
source, and security details we share with you.
This section does not cover information that is or becomes public through no fault of the receiving party, that
was already known to it, or that it developed independently.
8. Feedback
If you send us ideas or feedback, we may use them freely, without any obligation to you.
9. Suspension and termination
9.1 By you. You may stop using Tartan at any time and ask us to delete your org (section 7.7).
9.2 Suspension by us. We may suspend all or part of your org's access, with notice where that is practical, if:
you breach these Terms or the Acceptable Use Policy;
your use puts the security or stability of the Service, or of others, at risk;
the law requires it; or
paid fees are overdue (section 6.2).
We will limit any suspension to what is reasonably needed, and lift it once the cause is resolved.
9.3 Termination by us.
We may terminate these Terms for your org if you materially breach them and do not fix the breach within 15 days of
notice.
We may terminate at once for a serious or repeated breach of the Acceptable Use Policy.
We may end free use of the Service, or discontinue the Service, on at least 30 days' notice.
9.4 What happens at the end.
The licence in section 4 ends, and your devices stop being able to use the hosted Service.
For 30 days afterwards, an Owner may ask us to help export the org's configuration. This does not apply if we
terminated for serious abuse.
After that, we delete Customer Data as described in section 7.7.
These sections survive the end of these Terms: 3.4, 4.3, 6 (amounts owed), 7.3, 7.6, 7.7, 7.9, 10, 11, 12, 14 and 15.
10. Warranties and disclaimers
10.1 Each party confirms that it has the authority to enter into these Terms.
10.2 THE SERVICE AND THE SOFTWARE ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT THE LAW ALLOWS,
TARTAN DISCLAIMS ALL OTHER WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY. THIS INCLUDES ANY WARRANTY OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE OR NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SERVICE WILL
BE UNINTERRUPTED OR ERROR-FREE, THAT IT WILL BE SECURE AGAINST EVERY THREAT, OR THAT IT WILL MEET YOUR REQUIREMENTS.
10.3 Not for high-risk uses. The Service is not designed for uses where a failure could lead to death, personal
injury, or severe physical or environmental damage. Examples are life support, emergency services and control of
critical infrastructure. Do not rely on the Service for those uses.
11. Limitation of liability
11.1 TO THE FULLEST EXTENT THE LAW ALLOWS, NEITHER PARTY IS LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL,
CONSEQUENTIAL OR PUNITIVE DAMAGES. NOR IS EITHER PARTY LIABLE FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL. THIS
APPLIES EVEN IF THE PARTY WAS TOLD SUCH DAMAGES OR LOSSES WERE POSSIBLE.
11.2 TO THE FULLEST EXTENT THE LAW ALLOWS, EACH PARTY'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS IS
LIMITED TO THE GREATER OF:
(A) US $100; AND
(B) THE FEES YOU PAID OR OWED TARTAN FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE
LIABILITY.
11.3 Sections 11.1 and 11.2 do not limit:
your obligation to pay fees;
your obligations under section 12;
liability for a breach of section 4.3 or of the Acceptable Use Policy;
liability that the law does not allow to be limited.
12. Indemnity
12.1 You will defend Tartan, and its members, managers and contractors, against any third-party claim arising from:
your Customer Data;
your or your Users' use of the Service in breach of these Terms or the law; or
access your org grants to another org.
You will pay the resulting damages, fines and reasonable costs.
12.2 For Customers on a paid plan, Tartan will defend you against any third-party claim that the closed-source
Software, as we provide it, infringes that party's US intellectual property rights, and will pay the resulting damages
and costs. This does not apply to claims caused by:
combinations with things we did not provide;
modifications made by anyone other than us;
open-source components; or
use in breach of these Terms.
If a claim is made or seems likely, we may modify the Software, get you a licence, or end your use of the Software and
refund the prepaid fees for it.
12.3 The party being defended must:
tell the other party promptly;
let the other party control the defence; and
cooperate reasonably.
The defending party may not settle in a way that admits fault on behalf of the defended party without its consent.
13. Changes to these Terms and our policies
13.1 We will update these Terms. Tartan is growing quickly, and we will update these Terms and the documents listed
in section 1.4 as it changes.
Each document carries a version and an effective date.
13.2 How we tell you. We have no email address for most Customers, so you agree that notice works as follows.
Material changes. We post the change and a summary in the changelog. We also show a notice in the console to
your org's Owners and Admins, who can review and accept it there. A material change takes effect no sooner than 30
days after we post it.
Other changes. Changes such as clarifications, new contact details, or changes that do not reduce your rights
are posted in the changelog, and take effect when posted.
Urgent changes. A change that the law requires, or that is needed to address a security risk, may take effect
sooner. We will post it in the same way.
Checking for notices. You agree to check the console and the changelog. A notice we give in either of these
ways counts as notice to you.
13.3 Our data use. We may change how we use personal data so that it goes beyond what section 7.3 and our Privacy
Policy allow. Examples are any sale of data, advertising, or AI training. If we do:
it is a material change under section 13.2;
it applies to your org only after one of its Owners explicitly accepts it in the console, and continued use alone
is not enough;
it applies only to data we collect after that acceptance;
data collected before then needs any consent the law requires from the people concerned.
13.4 Your choice.
If you do not agree to a change, stop using the affected part of the Service before the change takes effect. An
Owner may also ask us to delete the org.
Except as section 13.3 provides, if you continue to use the Service after a change takes effect, you accept the
changed Terms. An Owner or Admin accepting the change in the console accepts it earlier.
If you have prepaid for a term and a material change materially reduces your rights, you may end the affected paid
feature before the change takes effect and receive a pro-rated refund.
13.5 Signed agreements. A change does not alter an order form or other agreement that both parties have signed,
unless that agreement says so.
14. Disputes
14.1 Governing law.
These Terms are governed by the laws of the Commonwealth of Kentucky and by applicable US federal law, without
regard to conflict-of-laws rules.
The UN Convention on Contracts for the International Sale of Goods does not apply.
14.2 Courts.
Each party submits to the exclusive jurisdiction of the state and federal courts located in Campbell County,
Kentucky. That covers any dispute arising out of or relating to these Terms or the Service.
Either party may seek an injunction in any court to protect its intellectual property or confidential information.
14.3 Informal resolution first. Before filing a claim, the party raising it will write to the other party. Claims
to us go to hello@tartannetworks.com, with "Legal notice" in the subject line. The parties will then try in good faith
to resolve the claim for 30 days.
14.4 No class actions, no jury.
To the fullest extent the law allows, each party brings claims only on its own behalf. Neither party will bring a
claim as a plaintiff or class member in any class or representative action.
EACH PARTY WAIVES ANY RIGHT TO A JURY TRIAL.
14.5 Time limit. Any claim must be brought within one year after it arises, unless the law requires a longer
period.
15. General
15.1 Export and sanctions.
The Software includes encryption, and is subject to US export-control and sanctions laws.
You will not use, export or re-export the Service or the Software in breach of those laws. This includes use in
embargoed countries, and use by people in embargoed countries or on restricted-party lists.
15.2 Force majeure. Neither party is liable for a failure caused by events beyond its reasonable control. This does
not apply to a failure to pay.
15.3 Assignment.
You may not assign these Terms without our consent, except to a successor to your whole business.
We may assign these Terms to an affiliate, or to a successor to our business.
15.4 Independent parties. The parties are independent contractors.
15.5 Notices.
Notices to us go to hello@tartannetworks.com, or to 187 Pavilion Pkwy #131, Newport, KY 41071 for legal notices.
Notices to you are given as section 13.2 describes.
15.6 Publicity. We will not name you as a customer without your permission.
15.7 Entire agreement.
These Terms and the documents listed in section 1.4 are the entire agreement between the parties about the Service.
If any part of these Terms is unenforceable, the rest stays in effect.
A failure to enforce a right is not a waiver of it.
The headings and the plain-English summary do not affect how these Terms are interpreted.
